These Terms of Service ("Terms") govern your access to and use of the website www.totalsolutionshub.net (the "Website") and any services, communications, proposals, or engagements offered by TSH — Total Solutions Hub ("TSH", "we", "us", or "our"). By accessing the Website or engaging with our services, you agree to these Terms. If you do not agree, please do not use the Website or our services.
TSH designs, builds and delivers four types of service for businesses: (a) Custom AI agents (standalone) — built for the client and installed on the client's premises or hardware; (b) Hosted plans (Essential, Evolve, Partner) — custom AI agents operated by TSH on its servers in the European Union under a subscription; (c) TSH Let's Vibe! — fast, low-cost custom software, with or without AI agents; and (d) AI business integration consulting. The specific scope, deliverables, pricing and conditions of any project are agreed separately and individually with each client in a written proposal, quotation, statement of work or contract ("Engagement Agreement"), which takes precedence over the general information presented on this Website.
All images, renderings, graphics, mock-ups, and visual representations shown on this Website are provided for presentation and illustrative purposes only. They are intended to communicate concepts and do not necessarily represent the actual product, hardware, software, appearance, configuration, or deliverable a client will receive. Actual products and deliverables may differ in design, form, capability, and appearance, and are defined solely in the applicable Engagement Agreement.
Any durations, delivery times, timelines, prices, performance figures, percentages, capacities, savings, return-on-investment claims, or other numbers referenced on this Website are estimates and indicative examples only. They are based on typical or hypothetical scenarios and may vary significantly from one case to another depending on the client's requirements, data, environment, hardware, complexity, and other factors. No such figure constitutes a promise, commitment, warranty, or guarantee. Binding timelines and prices are established only within an individual Engagement Agreement, and even then may be subject to change by mutual agreement or due to factors outside our reasonable control.
Use cases shown on this Website describe types of agents and solutions TSH builds or is developing. The figures shown with them (for example time savings, conversion rates or output) are projected targets, not results achieved for a specific client and not guaranteed outcomes. Every solution is customised, so TSH does not publish a fixed price list; statements such as "the lowest on the market" describe TSH's pricing policy and are not a binding comparison with any specific provider.
The Website is provided "as is" and "as available". While we aim to keep information accurate and current, we make no representations or warranties of any kind, express or implied, as to the accuracy, completeness, reliability, or suitability of the information, content, or materials on the Website. Your use of the Website and reliance on its content is at your own risk.
TSH is based in Gijón, Asturias, Spain, and primarily serves clients in Asturias and northern Spain. We also offer our services to clients throughout Spain and the wider European Union / European Economic Area, and may, at our discretion, accept international clients outside Europe.
For clients outside our primary service area — including elsewhere in Europe and internationally — our ability to deliver, support, install, maintain, and respond may be subject to additional conditions, costs, travel, timeframes, technical and logistical limitations, and applicable local laws. Our responsibilities and liabilities toward such clients are correspondingly limited, and the specific terms applicable to any cross-border or international engagement will be defined and agreed individually in the relevant Engagement Agreement. Acceptance of any client or project outside our primary service area is at our sole discretion.
Unless the Engagement Agreement states otherwise: on full payment, the client owns the delivered agent instance, its configuration and the models fine-tuned on the client's data, and may use them indefinitely without any subscription. TSH retains ownership of its pre-existing tools, generic components and reusable core technology, and grants the client a perpetual, non-exclusive, non-transferable licence to use them as part of the delivered agent. Support after delivery is optional and provided on request under separate terms.
Hosted plans are subscriptions. The content of each plan (hosting, monitoring, security updates, backups, support and, depending on the plan, retraining, model and feature updates and new developments) is described on the Website and detailed in the Engagement Agreement. Service levels, including any uptime commitment, apply only as defined in the Engagement Agreement. Billing period, renewal, notice period and suspension for non-payment are set in the Engagement Agreement. Each client's agent runs in a dedicated instance; client data is never shared with or used for other clients. On termination, the client may request a handover of its agent and data to its own hardware; handover work is quoted separately unless included in the plan. After termination and any handover, TSH deletes the client's data within the period set in the Engagement Agreement.
TSH Let's Vibe! projects are built to the technical specifications agreed in writing in the Engagement Agreement. Work outside those specifications is a change request and is quoted separately. A warranty period, defined in the Engagement Agreement according to the agreed specifications, covers the correction of defects against those specifications. Maintenance is optional and paid. Unless agreed otherwise, the client owns the delivered software on full payment, while TSH keeps its pre-existing tools and its solution-generator pipeline.
AI agents assist people; they do not replace professional judgement. Outputs — including procedures, isolation (LOTO) certificates, job safety analyses, risk assessments, safety predictions and any other technical or safety-related content — must be reviewed and approved by competent persons of the client before use. Predictions (for example, of safety events) are probabilistic estimates, not certainties. The client remains responsible for decisions taken and for compliance with applicable safety regulations.
Clients must not use TSH services or delivered solutions for unlawful purposes, to infringe third-party rights, to process personal data without a valid legal basis, or for practices prohibited by the EU AI Act. TSH may suspend a hosted service used in breach of this clause.
All content on this Website — including text, graphics, logos, images, design, and the "TSH" and "Total Solutions Hub" names and marks — is the property of TSH or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Website without our prior written permission. Ownership and licensing of any product or deliverable provided to a client are governed by the applicable Engagement Agreement.
To the fullest extent permitted by applicable law, TSH shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities, arising out of or in connection with your use of the Website or reliance on its content. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law. Liability arising from any specific project or service is governed and limited by the applicable Engagement Agreement.
The Website may contain links to or integrations with third-party websites or services (for example, scheduling or booking tools). We are not responsible for the content, policies, or practices of any third party, and accessing them is at your own risk and subject to their own terms.
We may update these Terms from time to time. The "last updated" date above reflects the most recent version. Continued use of the Website after changes are posted constitutes acceptance of the revised Terms.
These Terms are governed by the laws of Spain. Subject to any mandatory consumer protection rules that may apply, any dispute arising in relation to the Website or these Terms shall be submitted to the competent courts of Gijón / Oviedo, Asturias, Spain. For engagements, the governing law and jurisdiction set out in the applicable Engagement Agreement shall prevail.
